Hamilton, Miller & Birthisel Lawyers Obtain Summary Judgment in Jones Act Case Which is Affirmed by the Third District Court of Appeals on Appeal.   Liaugminaite v. Royal Caribbean Cruises, Ltd. 903 So.2d 298 Fla.App. 3 Dist.,2005.  Lolita Liaugminaite was a cabin attendant who claimed that she suffered back and related injuries as a result of repetitive luggage lifting over a five-year period leading up to April 2000 and a fall from her top bunk bed on April 23, 2002.  The Third District Court of Appeal affirmed summary judgment in Royal Caribbean’s favor, finding Lolita’s luggage-lifting claims time barred. This case was particularly significant since there were no cases on point in our jurisdiction, and thus, the case raised an issue of first impression in our courts.
 

Hamilton, Miller & Birthisel Lawyers Obtain Dismissal of Action Against Ship Doctor for Lack of Personal Jurisdiction.  Judge Ronald Friedman grants ship’s doctor’s motion to dismiss for lack of personal jurisdiction finding jurisdiction was lacking where ship’s doctor did not treat passenger in Florida state territorial waters and where ship doctor’s contact with the state of Florida was limited to sporadic visits to the State when the ship upon which he worked called to a Florida port.
